These terms are the agreement for using PhotosInFrame’s apps, website, and related services.

By creating an account or using PhotosInFrame, you agree to these Terms of Service (“Terms”) and our Privacy Notice. If you do not agree, do not use the service. The product is currently in development and is not yet generally available.

A note about photos

PhotosInFrame is not a backup service. Keep your own copies of photos you want to preserve. Deletion, account loss, or loss of every approved key-holding device may permanently make photos unavailable.

The service

PhotosInFrame lets households share encrypted photos with other households they choose. Sharing is directional: receiving another household’s photos does not automatically share yours back. Features may include photo delivery, Photo Memories, slideshows on supported devices, exports, household administration, and notifications.

We may improve, add, remove, limit, or discontinue features. We will use reasonable care when making changes that materially affect active users, but we do not promise that any feature or device support will remain available forever.

Accounts, households, and devices

You must provide accurate information, use an account you are authorized to use, and be legally capable of agreeing to these Terms. You are responsible for activity through your account and approved devices and for keeping them secure. Tell us promptly if you believe an account or device has been compromised.

Household Owners and Co-owners can make decisions that affect members, devices, sharing, and photos. The sole Owner has responsibilities that cannot be transferred in the current version. You should approve only people and devices you trust.

Some functions depend on third-party services, including Google sign-in, Microsoft Azure hosting, Apple notifications, and the operating systems on supported devices. Their terms may also apply to your use of those services.

Your content and permissions

You keep ownership of photos, captions, and other content you submit. You give us a limited, worldwide, non-exclusive license to host, process, transmit, and display that content only as needed to operate, secure, and support PhotosInFrame and to comply with law. This license ends when the content is deleted, except where limited retention is legally permitted or technically necessary for security.

You represent that you have the rights and permissions needed to upload and share your content, including images of other people. Do not upload unlawful content or content that violates another person’s privacy, copyright, publicity, or other rights.

Photo content is encrypted before upload, but recipients can view and export photos they are authorized to receive. We cannot recall copies they save outside PhotosInFrame. Optional captions are service-visible and should not contain personal or sensitive information.

Acceptable use

You may not use PhotosInFrame to:

  • Break the law, threaten or exploit anyone, or distribute abusive or illegal content.
  • Infringe intellectual-property, privacy, publicity, or other rights.
  • Access another person’s account, household, device, photos, or keys without permission.
  • Probe, disable, evade, or interfere with security, access controls, rate limits, or service operation.
  • Introduce malware, automate abusive traffic, resell access, or use the service to build a competing dataset.
  • Misrepresent your identity or household authority.

We may remove content or suspend access when reasonably necessary to protect people, the service, or legal rights. A suspension does not necessarily delete encrypted content or keys.

Suspension, deletion, and ending the service

You may stop using the service at any time. Available account-deletion tools and retention practices are described in the Privacy Notice. A user or household deletion request may have a 30-day restoration period before permanent purge. Photo deletion does not have a trash or recovery copy, and exported copies cannot be recalled.

We may limit or suspend access for a violation of these Terms, security risk, legal requirement, harm to others, or material risk to the service. We may terminate the service, and where practical will give reasonable notice so users can export content they are entitled to access. Sections that by their nature should survive termination—including ownership, disclaimers, liability limits, and dispute provisions—will survive.

Disclaimers

To the extent permitted by law, PhotosInFrame is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not guarantee that photos or accounts can always be recovered. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

Limits of liability

To the maximum extent permitted by law, PhotosInFrame and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business opportunity, arising from the service. Our total liability for claims relating to the service will not exceed the greater of the amount you paid for the service during the 12 months before the event giving rise to the claim or US $100.

These limits do not apply where prohibited by law and do not limit liability that cannot legally be limited.

Your responsibility

To the extent permitted by law, you will defend and indemnify PhotosInFrame and its operators against third-party claims, losses, and reasonable costs arising from your unlawful content, your misuse of the service, or your material violation of these Terms. This does not apply to the extent a claim results from our own conduct.

Applicable law and disputes

Applicable law governs these Terms and any dispute, without overriding consumer protections that apply where you live. Before filing a formal claim, you and PhotosInFrame agree to make a good-faith effort for 30 days to resolve the issue by contacting the other party. Either party may seek urgent relief when needed to prevent immediate harm.

Changes to these terms

We may update these Terms as the service changes. We will post revised Terms here and update the effective date. If a change materially affects your rights, we will provide additional notice when required. Continuing to use the service after revised Terms take effect means you accept them.
